Terms of Service

Article 1 Purpose of the Terms

These terms aim to define the conditions and procedures for using the internet services (hereinafter referred to as "Service") provided through the web solution offered by Somssi Good Obstetrics and Gynecology (hereinafter referred to as "Somssi Obstetrics and Gynecology"), as well as other necessary matters.

Article 2 Definitions of Terms

1. Somssi Good Obstetrics and Gynecology: A web service solution created by Kidsnet Co., Ltd. to build websites for the Moamom Childcare Foundation and provide internet services.

2. Member: A user who agrees to the terms of service and enters into a service contract with "Childcare Center," utilizing the "Service" provided by the "Childcare Center."

3. ID: A combination of letters and numbers set by the "Member" and approved by the "Childcare Center" for identifying the "Member" and using the "Service."

4. Password (PW): A combination of letters or numbers set by the "Member" to verify that they are the same "Member" who was assigned the "ID" and for confidentiality.

5. Administrator: An operator of the "Site" that has entered into a contract with the "Company" for internet services and is authorized by the "Company" to manage members and services.

Article 3 Membership Registration

1. A person wishing to register as a member must fill in their personal information according to the membership registration form specified by the "Childcare Center" and click the "Register" button to apply for membership.

2. The "Childcare Center" approves membership registration for the parents or family members of children enrolled in the center who have applied for membership according to the procedures in Paragraph 1.

However, membership registration may be restricted in the following cases: ① If false information, omissions, or errors are included in the registration form.
② If the application is made under a pseudonym or using someone else's name.
③ If the application is made for the purpose of disrupting the peace of the "Childcare Center" or public morals.
④ If the applicant does not meet the specific application requirements presented by the "Childcare Center."

3. The "Childcare Center" may restrict the acceptance of applications in the following cases and may postpone acceptance until the reason is resolved: ① If the capacity of the service-related facilities is insufficient.
② If there are technical or operational issues.
③ If the "Childcare Center" deems it necessary for other reasons.

Article 4 Modification of Member Information and Loss of Qualification

1. Members can view and modify their personal information at any time through the personal information management screen. However, essential details required for service management, such as real name and ID, cannot be modified.

2. If there are changes to the information provided during membership application, the "Member" must log in online to modify their personal information.

3. The "Childcare Center" is not responsible for any disadvantages arising from failure to modify changes specified in Paragraph 2.

4. The "Childcare Center" and the "Company" can terminate the service contract or temporarily suspend service usage without prior notice if the "Member" falls under any of the following categories: ① If it is revealed that false information has been provided during registration or that someone else's name has been used.
② If the "Member" misuses someone else's service ID and password.
③ If the "Member" engages in acts prohibited by these terms or contrary to the peace of the "Childcare Center" or public morals while using the service.
④ If the operation of the service is jeopardized or hinders sound operations.
⑤ If any other violations of applicable laws or the conditions of use set by the "Childcare Center" occur.

Article 5 Obligation to Protect Personal Information

The "Childcare Center" and the "Company" strive to protect the personal information of "Members" in accordance with relevant laws, including the "Act on Promotion of Information and Communications Network Utilization and Information Protection." The protection and use of personal information are governed by related laws and the personal information handling policy established by the "Childcare Center" and the "Company." However, the privacy policy of the "Childcare Center" and the "Company" does not apply to linked sites outside of the official site of the "Childcare Center."

Article 6 Obligation to Manage "Member's" "ID" and "Password"

1. The responsibility for managing the "Member's" "ID" and "Password" lies with the "Member," and it must not be used by a third party.

2. If there are concerns about the potential leakage of the "Member's" "ID" or if it contradicts public morals or misleads users into thinking they are the operators of the "Childcare Center" and its website, the "Childcare Center" may restrict the use of that "ID."

3. If the "Member" realizes that their "ID" and "Password" have been stolen or are being used by a third party, they must immediately notify the "Childcare Center" and follow its instructions.

4. The "Childcare Center" is not responsible for any disadvantages arising if the "Member" fails to notify them of such incidents or does not follow the "Childcare Center's" instructions after notifying.

Article 7 Obligations of "Members"

1. "Members" must not engage in the following actions: ① Providing false information when applying for or changing membership.
② Applying for membership using someone else's name.
③ Misusing someone else's "ID" and "Password."
④ Planning and executing the use of the service to hinder the "Childcare Center."
⑤ Posting or disseminating obscene or violent messages, images, voices, or other information contrary to public morals.
⑥ Damaging the reputation or interfering with the business of the "Childcare Center" or any third party.
⑦ Infringing on the copyrights and intellectual property rights of the "Childcare Center," the "Company," or other third parties.
⑧ Engaging in any actions that could disrupt the stable operation of the service.
⑨ Using the service for profit without the consent of the "Childcare Center."
⑩ Sending or posting information (such as computer programs) other than the information set by the "Childcare Center."
⑪ Other illegal or unjust actions.

2. If the "Childcare Center" and the "Company" discover a "Member" or user engaging in any of the actions specified in Article 7, Paragraph 1, they may suspend that individual's qualifications or revoke their membership.

Article 8 Obligations of the "Company"

1. The "Company" shall not engage in any acts prohibited by related laws or these terms that violate public morals and shall make every effort to provide continuous and stable service.

2. The "Company" shall thoroughly manage and secure the personal information (credit information) of "Members" to ensure safe usage of the service and shall publish and adhere to its personal information handling policy. However, the "Company" is not responsible for any issues arising from negligence in managing accounts by the "Childcare Center" or "Administrator."

Article 9 Obligations of the "Administrator"

1. The "Administrator" must not violate related laws, the provisions of these terms, or any other service terms and must not engage in the following acts: ① Leaking or stealing the personal information of "Members."
② Misusing the "Member's" "ID."
③ Operating the site for purposes other than normal site operations.
④ Sending spam emails, pornographic emails, or advertising emails without the "Childcare Center's" approval while using the service, or posting information contrary to public morals.
⑤ Operating and managing the site in violation of the copyrights and intellectual property rights of the "Childcare Center," the "Company," or other third parties.
⑥ Engaging in any acts that could disrupt the stable operation of the service.
⑦ Commercially using information obtained through the "Childcare Center's" service without prior consent.
⑧ Posting pornography on the bulletin board or linking to pornographic sites, neglecting commercial spam posts, or failing to take action despite being aware of such posts.
⑨ Hacking or distributing computer viruses.
⑩ Any other acts in violation of related laws.

2. The "Administrator" must take care to prevent member data from being leaked, and if any issues arise regarding member data leakage or service problems due to the administrator functions (the "Administrator's" "ID" and "Password"), all responsibility lies with the "Administrator."

Article 10 Rights and Responsibilities Regarding Posts

1. Copyrights and other intellectual property rights for works created by the "Childcare Center" belong to the "Childcare Center."

2. All rights and responsibilities, including copyrights for posts made by the "Administrator," lie with the "Administrator."

3. All rights and responsibilities, including copyrights for posts made by "Members," lie with the "Member" who made the post.

Article 11 Management of Posts

1. If a "Member's" post contains content that violates the "Information and Communications Network Act" and the "Copyright Act" or other related laws, the "Administrator" can request the suspension and deletion of that post in accordance with the procedures defined by related laws, and the "Childcare Center" must take action according to related laws.

2. If a "Member's" post exceeds the specified capacity, the "Childcare Center" can request the suspension and deletion of that post.

3. Even if there is no request according to the previous paragraphs, the "Childcare Center" can take temporary measures regarding the post in question if there is a reasonable basis for recognizing a rights infringement or if it violates other company policies and related laws.

Article 12 Provision of Services

1. The "Company" provides the following services to the "Childcare Center" and "Members": ① Server management and hosting services for the "Childcare Center's" internet and mobile services.
② Bulletin board services (general bulletin boards, album boards, etc.).
③ Communication-type bulletin board services (notification books, medication request forms, etc.).
④ Security services.
⑤ Any other services provided to the "Childcare Center" through additional development by the "Company" or through partnership contracts with other companies.

2. Services are provided year-round, 24 hours a day.

3. The "Company" may limit the use of all or part of the service due to maintenance, replacement, malfunctions of information and communication equipment, communication interruptions, or significant operational reasons. In this case, the "Company" will notify the "Administrator" in advance. However, if there are unavoidable reasons that prevent prior notification, it can be done afterward.

4. The "Company" may conduct regular maintenance as necessary for the provision of services, and the regular maintenance times will be announced on the service provision screen.

Article 13 Changes to Services

1. The "Company" may change all or part of the services it provides for significant operational or technical reasons.

2. If there are changes to the content, usage method, or usage time of the "Service," the reasons for the changes, the content of the changes, and the date of provision must be posted on the initial service screen before the changes take effect.

Article 14 Provision of Information by the Company and Posting of Advertisements

1. The "Company" may provide various information deemed necessary to "Members" during the use of services through announcements or email.

2. The "Company" may post advertisements in the banner space of the service site, in emails, etc., related to service operations.

Article 15 Ownership of Rights

1. Copyrights and intellectual property rights for the service belong to the "Company." However, this excludes "Members'" "posts" and works provided under partnership agreements.

2. The "Company" grants "Members" only the right to use accounts, "IDs," content, bulletin boards, etc., under the conditions set by the "Company," and "Members" may not transfer, sell, or provide collateral for these rights.

Article 16 Amendments to Terms

1. The "Company" may amend these terms within the scope that does not violate related laws, such as the Act on the Regulation of Terms and Conditions, the Basic Electronic Transaction Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization, and the Consumer Protection Act.

2. When the "Company" amends the terms, it will announce the effective date and reasons for the amendment on the main page of the "Company" website from 7 days before the effective date until the day before the effective date.

3. If the "Company" amends these terms, the amended terms will apply to users who joined before the amendment as long as they do not violate relevant laws.

Article 17 Rules Beyond the Terms

Matters not specified in these terms will be governed by the Act on the Regulation of Terms and Conditions, the Basic Electronic Transaction Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Utilization, the Consumer Protection Act, and other relevant laws.

Article 18 Limitation of Liability

1. The "Company" is exempt from responsibility for failing to provide services due to natural disasters or other force majeure events.

2. The "Company" is not liable for service interruptions due to faults caused by "Members" or "Childcare Centers."

3. The "Company" is not responsible for the reliability or accuracy of information, materials, or facts posted by "Members" regarding the service.

4. The "Company" is exempt from liability in cases where "Members" engage in transactions using the service with other "Members" or third parties.

Article 19 Governing Law and Jurisdiction

1. Lawsuits arising from disputes regarding service use between the "Childcare Center" and "Members" will be filed in the court with jurisdiction over the "Childcare Center" operating the service.

2. The "Company" and "Members" must make every effort to resolve disputes arising from the service amicably. If a lawsuit is filed despite all efforts, it will be subject to the jurisdiction of the court where the "Company" is located.
